General Terms and Conditions
Last updated: October 2026
§ 1 Scope and contracting party
These General Terms and Conditions apply to all orders placed via the online shop livaglow.de. Your contracting party is Yusuf Senel, Log-System Development, Von-Hünefeld-Str. 8, 40764 Langenfeld (Rheinland), email mail@livaglow.de, phone +49 (0) 2173 1618220 (hereinafter “we”). Further details can be found in the imprint.
Our offer is directed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB, German Civil Code). If businesses place orders, these terms apply as well; we do not recognise any deviating terms and conditions of the customer. We are a small business (Kleinunternehmer) under § 19 UStG (German VAT Act) and do not show VAT; input VAT cannot be deducted on the basis of our invoices.
§ 2 Conclusion of the contract
The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to you to submit an offer. The ordering process consists of the following steps:
- You design your mug in the designer (text, photos, emojis, cliparts, background) and check it in the 2D view and the 3D preview. Clicking “Add to cart” saves the design.
- In the cart you see all items with preview, quantity, unit price, discounts, shipping costs and total amount. There you can change quantities, remove items, reopen a design via “Edit” and redeem discount codes.
- At checkout you enter your email address and delivery address and optionally choose the gift option, the newsletter and the review request. Before you submit the order, the order summary shows all items and amounts once more.
- By clicking “Place order and pay” you submit a binding offer to purchase the goods contained in the cart. You are then redirected to the payment page of our payment service provider Stripe, where you complete the payment. If you cancel the payment, no contract is concluded.
The purchase contract is concluded when we accept your offer. We declare acceptance by means of the order confirmation by email, which we send immediately after receipt of your payment and to which the invoice is attached. The automatic display of the order number after payment is for information purposes only. If, exceptionally, we do not accept an offer (§ 9), we will refund any payment already made without undue delay.
§ 3 Input errors, contract language and contract text
Input errors can be corrected at any time until you click “Place order and pay”: in the designer via the edit, undo and delete functions, in the cart via the quantity fields, “Remove” and “Edit”, at checkout by changing the input fields or via the back function of your browser. Before you submit the order, the order summary summarises all details. Please check your design particularly carefully before ordering, because it will be printed exactly as it is (§ 4).
The contract languages are German and English. You can order via the German or the English pages; you will receive the order confirmation and the invoice in the language in which you ordered. The English version of these terms and conditions is a translation; in the event of any discrepancy, the German version prevails.
Contract text. We store your order data and these terms in the version valid at the time the contract is concluded. With the order confirmation you receive the essential contract contents, the invoice and links to the terms and conditions and the withdrawal policy by email. You can access, save and print the terms and conditions at any time at livaglow.de/agb (this English translation: livaglow.de/en/terms). Once the order has been completed, your order data can no longer be accessed via the website; you can see the status of your order under “Track order” using your order number and email address.
§ 4 Personalisation and print approval
Each mug is printed individually according to your design. By clicking “Place order and pay” you approve the design in the form in which it is shown in the cart. We do not check designs for spelling, image cropping, resolution or layout and do not make any changes to their content. In particular:
- The entire print area of 200 × 93 mm is printed. Elements inside the dashed line (safety margin 5 mm) are printed in full; elements outside it may be cut off at the edge or in the handle zone. The top and bottom edges of the mug and the area at the handle remain unprinted.
- Photos should be at least 1000 pixels wide. The designer warns you about smaller images; if you nevertheless decide to use such an image, lower sharpness is not a defect.
- Colours are displayed differently on screen and in print. Production-related deviations in hue, brightness and contrast that are customary in sublimation printing do not constitute a defect. Pure white in the design corresponds to the colour of the mug and is not printed.
- Emojis are printed the way your device displays them in the designer. Their appearance may differ from that on other devices.
The design can only be changed after ordering as long as production has not yet started. To do so, write to us as soon as possible at mail@livaglow.de, stating your order number; there is no entitlement to a change.
§ 5 Prices and shipping costs
All prices stated are final prices in euros. In accordance with § 19 UStG, no VAT is charged or shown (small business scheme). One mug costs €14.99; from the second mug in an order we grant a volume discount of 15% on every additional mug (€12.74), regardless of whether the mugs have the same design. The discount is shown in the cart.
In addition, shipping costs apply; they depend on the shipping method selected in the cart and amount to between €3.90 and €8.90 per order; personal delivery within 40764 Langenfeld is free of charge. For goods with a value of €39.90 or more (sum of the list prices before discounts) we deliver free of shipping costs; if you choose “DHL to your address”, a surcharge of €4.00 then remains. The shipping costs are shown in the cart and at checkout before you order. No further taxes or fees apply for deliveries within Germany.
§ 6 Payment, discount and promotional codes
Payment is processed via the payment service provider Stripe (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin, Ireland). The payment methods offered there are available, in particular credit card, PayPal, Klarna, Apple Pay, Google Pay, Amazon Pay and Revolut Pay. The purchase price is due when the order is placed; production only begins after receipt of payment. We ourselves do not offer purchase on account or payment in advance; if you choose Klarna, Klarna’s terms apply to the payment method and the due date.
Discount and promotional codes (e.g. the welcome discount from the newsletter, partner codes) may be subject to conditions, such as a minimum order value, a period of validity, a limited number of redemptions or single use per person. They are applied to the value of the goods already reduced by the volume discount. Only one code can be redeemed per order; codes cannot be combined with other promotional codes, are not transferable, cannot be paid out in cash and will not be reissued in the event of cancellation if they have expired.
Gift vouchers (mug voucher) entitle the holder to order one personalised mug including standard shipping within Germany. If the person redeeming the voucher orders several mugs, the price of one mug is credited; if a shipping method with a surcharge is chosen, only the surcharge has to be paid. A voucher can be redeemed once, cannot be paid out in cash and – unlike promotional codes – is transferable. It is valid until 31 December of the third year after the year of purchase. The voucher is delivered by email as a PDF after receipt of payment.
§ 7 Delivery
We deliver exclusively to delivery addresses within Germany. You choose the parcel service in the cart (UPS or DHL); with the shipping method “UPS to a pickup point”, the parcel is delivered to a UPS Access Point near you. We currently do not deliver to DHL Packstations; if you cannot accept the parcel at the front door, choose a UPS pickup point. For addresses within 40764 Langenfeld we additionally offer the free “Personal delivery in Langenfeld”: we bring the mug round ourselves, usually within two days of printing; there is no tracking number for this. As each mug is made individually for you, the delivery time is usually 3–6 working days (Monday to Friday, excluding public holidays) after receipt of payment. In the cart and at checkout we show the expected delivery period calculated from this. For parcel shipping you receive a shipping confirmation with tracking number by email.
If a shipment cannot be delivered because of an incorrect address provided by you and it is returned to us, we will contact you. You bear the costs of re-shipping insofar as you are responsible for the incorrect information. We are entitled to make partial deliveries if this is reasonable for you; you will not incur any additional shipping costs as a result.
For consumers, the risk of accidental loss and accidental deterioration of the goods only passes to you upon handover of the goods to you. Nevertheless, please report obvious transport damage to mail@livaglow.de as promptly as possible, ideally with a photo; this makes it easier for us to handle the matter with the parcel service, but it is not a precondition for your rights.
§ 8 Right of withdrawal
Consumers are generally entitled to a statutory right of withdrawal for distance contracts. Details and the model withdrawal form can be found in the withdrawal policy.
Important: Pursuant to § 312g Abs. 2 Nr. 1 BGB, there is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or that are clearly tailored to the personal needs of the consumer. Individually printed mugs with your own design fall under this exception. Your warranty rights (§ 11) remain unaffected.
§ 9 Rights to uploaded content, rejection of motifs
By uploading images, texts or other motifs, you warrant that you hold the necessary rights of use and that printing them does not infringe any rights of third parties (in particular copyrights, trademark rights, design rights and personality rights) or any statutory prohibitions. Persons depicted must have consented to the use. You grant us the simple (non-exclusive) right, limited to processing the order, to reproduce and store the content in order to produce your mug (see the deletion periods in the privacy policy). Any use beyond this, for example for advertising purposes, does not take place without your express consent.
We reserve the right to refuse to produce motifs that, in our assessment, are unlawful, glorify violence, incite hatred against parts of the population (Volksverhetzung), are discriminatory, pornographic or harmful to minors, or that recognisably use third-party trademarks, logos or protected characters without authorisation. In this case we will inform you by email and refund the amount paid in full; there are no further claims. You shall indemnify us against claims of third parties based on a culpable breach of your obligations under this section, including the reasonable costs of legal defence.
§ 10 Retention of title
The goods remain our property until they have been paid for in full.
§ 11 Warranty (liability for defects)
The statutory rights in respect of defects apply. For consumers, the limitation period for claims for defects is two years from handover of the goods. In the event of transport damage, breakage, printing errors or a print that deviates from your approved design, we will, at your choice, supply a new mug free of charge or refund the purchase price; as a rule we do not require the damaged mug to be returned, but we ask for a photo for documentation.
The production-related deviations described in § 4 do not constitute a defect, nor do errors based on your approved design (e.g. spelling mistakes, unfavourable image cropping, insufficient image resolution despite a warning, elements outside the safety area). We provide no warranty for damage caused by improper use, in particular contrary to the safety and care instructions (German). Please send complaints, stating your order number, to mail@livaglow.de.
§ 12 Liability
We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, in the event of fraudulent concealment of a defect, where we have assumed a guarantee, and under the German Product Liability Act (Produkthaftungsgesetz). In the event of a slightly negligent breach of an essential contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. This provision also applies to our legal representatives and vicarious agents.
§ 13 Data protection
Which personal data we process when you visit our website, place an order and communicate with us, how long we store designs and order data and which rights you have is explained in our privacy policy.
§ 14 Dispute resolution
The European Commission’s online dispute resolution platform was discontinued as of 20 July 2025. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz, VSBG). If you have any questions or complaints, please contact us directly at mail@livaglow.de; we usually reply on the next working day.
§ 15 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence. If the customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is our place of business. Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected; the statutory provisions shall apply in place of the invalid provision.
